Delhi HC seeks BCCI response on copyright infringement petition by Delhi Press Patra Prakashan

The Delhi High Court on Wednesday sought response from the Board of Control for Cricket India (BCCI) and others on a copyright infringement petition by Delhi Press Patra Prakashan, but refused to give any immediate relief to the publishers of Champak magazine.The publisher wants to restrain the cricket board from using of the name 'Champak' for the robotic dog introduced in the Indian Premier League (IPL), alleging that it infringed its registered trademark ‘Champak’.Justice Saurabh Banerjee while refusing an interim order said that the name ‘Champak’ was not adopted by the entity “per se,” but was the result of an online poll conducted by the cricket body.Counsel Amit Gupta, representing Delhi Press, argued that IPL was a commercial venture and the BCCI was advertising, marketing and earning through its robotic dog. Use of the name 'Champak' amounts to tarnishing its image and its unauthorised use amounted to taking unfair advantage by the cricket board. He submitted that the Champak magazine is quite popular among children and the use of its name for the product introduced by the BCCI is a clear infringement of the publisher's registered mark.However, senior counsel J Sai Deepak, appearing for the BCCI, BCCI argued that 'Champak' was the name of a flower and the name was associated with a character in the Hindi situational comedy TV show Taarak Mehta ka Ooltah Chashmah.The court will further hear the case on July 9.Champak, the robotic dog with a mounted camera - it can walk, run, jump and also stand on its hind legs - was launched this IPL season as part of the league’s marketing and production strategy.The dog, first seen during a Mumbai Indians versus Delhi Capitals match at the Arun Jaitley Stadium in Delhi earlier in April, was introduced by global technology leader wTVision in collaboration with Omnicam and BCCI.Champak reacts in real time with players, umpires and fans by performing gestures such as handshakes, jumps and heart signs.
