The bail hearing for former Attorney-General Aiyaz Sayed-Khaiyum has been postponed because of his medical condition. He is suffering from a stroke and heart disease.
His lawyers, Devanesh Sharma and Gul Fatima, told the High Court in Suva about his serious health problems and asked for the hearing to be delayed.
Only his co-accused, former Supervisor of Elections Mohammed Saneem, appeared in court yesterday.
Ms Fatima told the court that their client collapsed at home in Nadi on Monday afternoon and was taken to Heart International hospital. His cardiologist then referred him to the Aspen Medical-managed Lautoka Hospital, where he is now being treated.
“The doctors say Sayed-Khaiyum is weak and has neurological problems, so they don’t know when he can be discharged. The court was told he will need another check-up in two weeks.”
Ms Fatima asked the court to keep their request on hold until they receive an updated report from the doctors.
Ms Fatima said Sayed-Khaiyum’s wife and three children are with him at the hospital.
Acting Director of Public Prosecutions, Nancy Tikoisuva, did not object to the request but said they had already replied with affidavits from three local doctors saying Sayed-Khaiyum is well and can be treated locally.
Ms Fatima said they would return on the next court date to update the court on their client’s condition and to provide their reply affidavit.
For now, Justice Temo wished Sayed-Khaiyum a speedy recovery and gave the defence until August 1 to sort out their matters.
This time will also allow both sides to work on pretrial issues, including agreed facts and documents.
