Special Prosecutor reiterates calls for lifestyle audits, asset seizures without conviction

Kissi Agyebeng, the special prosecutor, has reaffirmed calls for constitutional amendments that would give state agencies the authority to perform lifestyle audits and remove property from those whose wealth is judged out of proportion to their legitimate income, even in the absence of a criminal conviction.
Mr. Agyebeng made the case that the legal system needs to change to keep up with the complexity of contemporary corruption schemes while giving the keynote address at the West Africa Regional Anti-Corruption Policy Dialogue in Accra. He also called for a “reverse onus” clause in the Constitution, which would presume that wealth that cannot be explained was obtained through corrupt means unless the owner could demonstrate otherwise.
His topic of discussion was Ghana’s Accountability Journey: Revitalising Africa’s Anti-Corruption Architecture.
He claimed that “criminal innovation always seems to be one step ahead of the law.” “Those who commit grand corruption have the resources to launch powerful disinformation and truth-bending campaigns.”
He claims that because present prosecuting techniques frequently call for a conviction before confiscation can occur, they are insufficient for tracking down and recovering illicit riches.
“Prevention is always better than cure in matters of anti-corruption,” Mr. Agyebeng explained, describing lifestyle auditing as the most proactive and economical method of combating massive corruption. Because of ingrained secrecy and wealth piling, investigations and prosecutions are time-consuming, costly, and frequently ineffective.
He argued that constitutional reforms would not only strengthen Ghana’s domestic accountability mechanisms but also harmonise its framework with international standards.
“Unexplained wealth must not be allowed to hide behind legal technicalities. The people demand transparency and accountability.”
