The family of a 95-year-old grandmother has filed a lawsuit against the mortuary that they say caused their loved one to miss her own funeral.
Lucy Mae Johnson of Atlanta passed away in July 2023. Her heartbroken granddaughter, Marva Lynch of Rockville, Maryland, was tasked with planning her family's final goodbye.
She made funeral arrangements with Donald Trimble Mortuary in Decatur, Georgia, providing them with clothes and a wig for Johnson to be buried in.
But on the day of the ceremony, another woman was laying in Johnson's place, a lawsuit Lynch filed on May 1, 2025 claims, The Atlanta Journal-Constitution reported.
'Upon information and belief, defendant dressed the wrong body in the wig and clothes provided by plaintiff for her grandmother’s burial,' the document, filed with the DeKalb County court, reads.
Before the coffin was shut for the closed-casket funeral, Lynch had only glanced at what was supposed to be her grandmother's body, not realizing anything was out of the ordinary.
She claimed she did not want to look too long, as she was already scarred from seeing her mother's corpse.
Since the body was concealed during the August 1, 2023 service, no one flagged that Johnson was missing.
The funeral home broke the news about the corpse mix-up after Johnson's family had already paid their respects, Atlanta News First reported.
'Most people expect to attend their own funeral,' Lynch's lawyer, Jonathan Johnson, told The Atlanta Journal-Constitution. 'This poor lady was denied the chance.'
The lawsuit - which accuses the funeral home of negligence, mishandling human remains and breach of contract - does not specify whose body was in Johnson's place during her funeral.
Forrest Johnson, Donald Trimble Mortuary's attorney, declined the outlet's request for comment about the lawsuit.
'We have just received the lawsuit and are looking into the allegations. Donald Trimble always strives to provide its customers with the highest level of care,' he said.
The three Johnsons - Lucy, Forrest and Jonathan - are not related.
The bodies were swapped to their proper coffins before being buried, but Lynch and her family are still dismayed and want justice for Johnson, who left behind six grandchildren and great-grandchildren, as well as seven great-great-grandchildren.
Lynch is demanding Donald Trimble Mortuary hands over punitive damages, including the more than $8,880 funeral home fee.
She has also requested payment for emotional distress brought on by the bizarre and unfortunate situation.
'As a direct and proximate result of Defendant's negligence, Plaintiff Marva Lynch experiences mental and emotional anxiety and distress,' the lawsuit claims.
Donald Trimble Mortuary opened in 1983 and plans more than 750 funeral services each year, according to its website.
In May 2020, a Houston, Texas family experienced the same shock and horror as Johnson's when two women discovered a stranger's corpse in their father's coffin before his funeral.
Susana Montelongo and Maria Vasquez hired Santana Funeral Directors following the death of their father, Natividad Torres Cordova.
The sisters asked the funeral home to dress Cordova in his favorite Mexican soccer jersey for the open casket service.
However, the pair - along with the rest of their family - were stunned to discover the company's shocking mix-up when the coffin arrived at the church with the wrong body inside.
'To say our last goodbyes to our father, it was supposed to be perfect,' Montelongo said in an interview Click2Houston.
'He gave us his all, so we wanted to give him everything, perfect.'
'Instead of having good memories of a perfect funeral for our father, because he deserved the best, we are having a nightmare.'
Vasquez tearfully told the news network: 'I went up to the casket to tell my dad "I love you" before anybody came in, and I was touching the wrong person, with my dad's clothes. They ruined everything.'
The family confronted the funeral directors about the shocking mix-up, before another relative went back with them to the funeral home to retrieve the correct body.
Cordova's body was eventually placed into a casket and sent to the church for his funeral service, which was carried out two hours late.
