ICC arrest warrants for heads of state contradict international law — Medvedev

MOSCOW, April 24. /TASS/. The arrest warrants issued by the International Criminal Court (ICC) for the leaders of sovereign states should be considered a violation of international law, representing a clear infringement of the United Nations Charter, according to Dmitry Medvedev, the Deputy Chairman of Russia’s Security Council. Medvedev articulated these views in an article published in the inaugural 2025 issue of the jurisprudence journal of Saint Petersburg State University.
"Regardless of how one interprets Articles 27 and 98 of the Rome Statute, the very act of issuing arrest warrants for heads of sovereign states by the Hague-based court constitutes a breach of international law, chiefly the UN Charter," Medvedev wrote.
He further elaborated that the ICC’s actions encroach upon the sovereignty of nations, including Russia - a permanent member of the UN Security Council - by attempting to restrict the exercise of their official functions. "ICC officials should be aware that by attempting to curtail the authority of a sovereign state’s leader - especially a Security Council permanent member - they are undermining the functioning of the central UN body responsible for maintaining global peace," Medvedev emphasized. "In a time when the international community is deeply divided and our planet teeters on the edge of World War III, the ICC’s decisions have already heightened global risks. Those at the Hague responsible for these actions bear significant responsibility for this escalation," he added.
Medvedev also pointed out that three of the five permanent members of the Security Council - Russia, China, and the United States - are not parties to the Rome Statute. Consequently, the treaty imposes no legal obligations on these nations.
